Freedom of speech is a principle that supports the freedom of an individual or a community to articulate their opinions and ideas without fear of retaliation, censorship, or legal sanction. The right to freedom of expression has been recognised as a human right in the Universal Declaration of Human Rights and international human rights law by the United Nations. Many countries have constitutional law that protects free speech. Terms like free speech, freedom of speech, and freedom of expression are used interchangeably in political discourse. However, in a legal sense, the freedom of expression includes any activity of seeking, receiving, and imparting information or ideas, regardless of the medium used.
Article 19 of the UDHR states that "everyone shall have the right to hold opinions without interference" and "everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive, and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice". The version of Article 19 in the ICCPR later amends this by stating that the exercise of these rights carries "special duties and responsibilities" and may "therefore be subject to certain restrictions" when necessary "[f]or respect of the rights or reputation of others" or "[f]or the protection of national security or of public order (ordre public), or of public health or morals". Universal City Studios, Inc. v. Nintendo Co., Ltd. was a case heard by the United States District Court for the Southern District of New York by Judge Robert W. Sweet. In their complaint, Universal Studios alleged that Nintendo's video gameDonkey Kong was a trademark infringement of King Kong, the plot and characters of which Universal claimed for their own. Nintendo argued that Universal had themselves proved that King Kong's plot and characters were in the public domain in Universal City Studios, Inc. v. RKO General, Inc. Sweet ruled that Universal had acted in bad faith by threatening Nintendo's licensees and that it had no right over the name King Kong or the characters and story. He further held that there was no possibility for consumers to confuse Nintendo's game and characters with the King Kong films and their characters. Universal appealed the case, but the verdict was upheld. The case was an enormous victory for Nintendo, which was still a newcomer to the U.S. market. The case established Nintendo as a major player in the industry and arguably gave the company the confidence that it could compete with the giants of American media. The case was selected as #20 on GameSpy's list of the "25 Dumbest Moments in Gaming".

Geert Wilders (Dutch pronunciation:[ˈɣeːrtˈʋɪldərs], born 6 September 1963) is a Dutch politician and the founder and leader of the Party for Freedom (Partij voor de Vrijheid – PVV), which is a political party in the Dutch parliament. Wilders is the Parliamentary group leader of his party in the Dutch House of Representatives. In the formation in 2010 of the Rutte cabinet, a minority cabinet of VVD and CDA, he actively participated in the negotiations, resulting in a "support agreement" (gedoogakkoord) between the PVV and these parties, but withdrew his support in April 2012, citing disagreements with the cabinet on proposed budget cuts. Wilders is best known for his criticism of Islam. Wilders' views regarding Islam have made him a controversial figure in the Netherlands and abroad, and since 2004 he receives permanent personal protection by armed bodyguards.(more...)
All speech should be presumed to be protected by the Constitution, and a heavy burden should be placed on those who would censor to demonstrate with relative certainty that the speech at issue, if not censored, would lead to irremediable and immediate serious harm.
